Welcome to Stealth Health, a telemedicine platform providing virtual healthcare services. By accessing or using our website at stealth.health, mobile application, or any services provided by Stealth Health (collectively, the "Services"), you agree to be bound by these Terms and Conditions ("Terms"). If you do not agree to these Terms, please do not use our Services.
These Terms form a legally binding agreement between you ("User," "you," or "your") and Stealth Health ("we," "us," or "our").
1. Acceptance of Terms
By registering for an account, scheduling a consultation, or otherwise using the Services, you confirm that you have read, understood, and agree to these Terms, as well as our Privacy Policy, which is incorporated herein by reference. We may update these Terms from time to time, and your continued use of the Services constitutes acceptance of any changes. We will notify you of material changes via email or through the Services.
2. Eligibility
To use the Services, you must:
Be at least 18 years old or the age of majority in your jurisdiction.
Reside in a jurisdiction where our Services are available and permitted by law.
Not be barred from using the Services under applicable laws.
If you are using the Services on behalf of someone else (e.g., a minor with parental consent where applicable), you represent that you have the authority to bind them to these Terms.
3. Services Provided
Stealth Health connects you with licensed healthcare providers ("Providers") for virtual consultations, diagnoses, prescriptions, and follow-up care via text, video, or audio. Our Services are intended for non-emergency medical needs and are not a substitute for in-person care or emergency services.
Telemedicine Consultations: Providers may diagnose conditions, recommend treatments, and prescribe medications where appropriate.
Prescriptions: Medications may be prescribed electronically and sent to your chosen pharmacy. We do not dispense medications directly.
Limitations: Services are not available for all conditions. Providers may refer you to in-person care if needed.
We do not guarantee the availability of Services at all times and reserve the right to modify or discontinue any part of the Services without notice.
4. User Responsibilities and Acknowledgments
As a condition of using the Services, you agree to the following:
Accurate Information: You understand that providing inaccurate or incomplete information may be dangerous to your health. You agree to provide complete, accurate, and up-to-date information about your medical history, symptoms, allergies, and other relevant details during consultations.
Medication Use: You confirm that any medication prescribed through Stealth Health is for your personal use only and that you will take it exactly as directed by the Provider. You will not share, sell, or misuse prescribed medications.
Side Effects and Emergencies: You agree to seek immediate medical or emergency care (e.g., by calling 911 or visiting an emergency room) if you experience serious or concerning side effects, allergic reactions, or any worsening of your condition. Stealth Health is not equipped to handle emergencies.
Updates to Health Information: You will keep Stealth Health informed of any changes to your medical history, medications, allergies, or health status that may affect your treatment.
Coordination with Primary Care: You understand that you are responsible for notifying your primary care provider (PCP) or other healthcare professionals about any treatment, diagnoses, or prescriptions received through Stealth Health to ensure coordinated care.
Compliance with Laws: You will use the Services only for lawful purposes and in compliance with all applicable federal, state, and local laws, including those related to healthcare and controlled substances.
Account Security: You are responsible for maintaining the confidentiality of your account credentials and for all activities under your account.
Informed Consent: By using the Services, you consent to virtual consultations, electronic communications, and the potential risks associated with telemedicine, such as technical failures or miscommunications.
Failure to comply with these responsibilities may result in termination of your access to the Services.
5. Provider Responsibilities
Our Providers are independent contractors licensed in the jurisdictions where they practice. Stealth Health facilitates connections but does not employ Providers directly. Providers agree to:
Provide care in accordance with professional standards.
Maintain confidentiality per applicable laws (e.g., HIPAA in the US).
Disclose any conflicts of interest.
However, Stealth Health does not guarantee the accuracy of diagnoses or treatments, as medical care involves inherent uncertainties.
6. Privacy and Data Protection
Your privacy is important to us. We handle your personal and health information in accordance with our Privacy Policy, which details how we collect, use, share, and protect your data. By using the Services, you consent to such processing. We comply with applicable privacy laws, including HIPAA where required.
7. Payment and Billing
Fees: Services may require payment for consultations, subscriptions, or other features. Fees are displayed at the time of booking and are non-refundable except as required by law.
Billing: You authorize us to charge your provided payment method. You are responsible for any taxes or fees associated with transactions.
Insurance: We may or may not accept insurance; check with your provider. You are responsible for verifying coverage.
Refunds: Refunds are at our discretion, typically for unused services only.
8. Intellectual Property
All content on the Services, including text, graphics, logos, and software, is owned by Stealth Health or its licensors and protected by intellectual property laws. You may not copy, modify, distribute, or create derivative works without our written consent.
9. Limitations of Liability
To the fullest extent permitted by law, Stealth Health, its affiliates, Providers, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Services, including but not limited to:
Errors in diagnoses or treatments.
Loss of data or interruptions in service.
Harm from reliance on information provided.
Our total liability shall not exceed the amount you paid for the Services in the preceding 12 months. Some jurisdictions do not allow limitations on liability, so these may not apply to you.
THE SERVICES ARE PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.
10. Indemnification
You agree to indemnify and hold harmless Stealth Health, its officers, directors, employees, Providers, and agents from any claims, damages, losses, or expenses (including attorneys' fees) arising from:
Your violation of these Terms.
Your misuse of the Services.
Any information you provide that is inaccurate or incomplete.
11. Termination
We may terminate or suspend your access to the Services at any time, with or without cause, including for violations of these Terms. Upon termination, your right to use the Services ceases immediately. Sections that by their nature should survive termination (e.g., liability, indemnification) will do so.
12. Governing Law and Dispute Resolution
These Terms are governed by the laws of the State of Delaware, USA, without regard to conflict of laws principles. Any disputes arising from these Terms shall be resolved through binding arbitration in Wilmington, DE, administered by the American Arbitration Association (AAA), except for small claims or injunctive relief. You waive any right to class actions.
13. Miscellaneous
Severability: If any provision of these Terms is held invalid, the remainder shall continue in full effect.
Waiver: No waiver of any term shall be deemed a further or continuing waiver.
Assignment: We may assign these Terms without your consent; you may not assign without our written approval.
Force Majeure: We are not liable for delays due to events beyond our control (e.g., natural disasters, pandemics).
Entire Agreement: These Terms, along with our Privacy Policy, constitute the entire agreement between you and Stealth Health.
